Terms of Service
These terms cover your use of PMC Assistant, a service run by Patrick McElroy Consulting LLC ("PMC", "we"). By using it you agree to them, for yourself and for the organization you use it for. If your organization has a signed agreement with PMC, that agreement wins wherever the two differ.
Who can use it
PMC Assistant is by invitation, for PMC's client businesses and the people they authorize. Admins at your organization decide who has access and what gets connected. Keep your sign-in to yourself, and tell us right away if you think someone has misused it.
Your data
Your organization's data stays yours. You give us permission to access and process it only as needed to run the service for you, as described in our Privacy Policy. You're responsible for having the right to connect the accounts, files and apps you connect, including following those apps' own terms when the assistant works in them.
The assistant can make mistakes
PMC Assistant uses AI, and AI can be wrong, incomplete or out of date. Check its work before you rely on it. It saves email as drafts for a person to send, and it asks for a person's approval before it changes your records or sends through other apps. Whatever you send or approve is your decision and your responsibility. It doesn't give legal, tax, financial or compliance advice.
Acceptable use
Don't use PMC Assistant to break the law or anyone's rights, to get into accounts or systems you aren't authorized to use, to get around a site's CAPTCHA or other security checks, or to interfere with or copy the service. Your use must also follow Anthropic's Usage Policy, since the assistant runs on Claude. We may suspend access to protect the service, your data or other people.
Other services
PMC Assistant relies on services we don't control, including Anthropic, Google, Microsoft and Railway, and on the apps you connect. We aren't responsible for their outages, changes or actions. If one of them changes or stops offering something, part of PMC Assistant may stop working.
Fees
Any fees are set in your organization's signed agreement or order with PMC.
Ownership
PMC owns the PMC Assistant software. As between you and PMC, your organization owns what it puts in and what the assistant produces for it. Other people may get similar results from AI tools, so we can't promise that what it produces is unique.
The service is still developing
We're actively building PMC Assistant. Features may change, and we don't promise any particular uptime here. If your organization needs a commitment on either, it belongs in your signed agreement.
Disclaimer
PMC Assistant is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.
Limit on liability
To the extent the law allows, PMC won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. PMC's total liability for all claims related to PMC Assistant won't exceed the greater of what your organization paid PMC for it in the 12 months before the claim and $100.
Claims about your use
If someone makes a claim against PMC because of data you connected without the right to, or because you broke these terms, your organization will cover PMC's reasonable losses and costs from that claim.
Ending access
You can stop using PMC Assistant at any time, and your organization's admins can remove your access. We may end access if these terms are broken or if we stop offering the service, and we'll give reasonable notice where we can. Afterward, your data is handled as the Privacy Policy describes. Sections that should logically continue, such as ownership, the disclaimer and the limit on liability, stay in effect.
Changes
When we change these terms we'll update them here and change the date at the top. For a significant change, we'll tell your organization's admins before it takes effect. Continuing to use PMC Assistant after that means you accept the change.
Governing law
These terms are governed by the laws of the state where Patrick McElroy Consulting LLC is organized, without regard to conflict-of-law rules.
